In a 1996 court case (Schlesinger v. Herzog, No. 95-CA-1127), a jury accepted the testimony of one expert over another expert. The jury listed the following reasons for their opinion:

In the case of Berg vs. the Commissioner of the Internal Revenue Service, the Tax Court set a new and higher standard for qualifications for experts who value ownership interests. As a result, experts must now be (i) primarily in the business of appraisal, (ii) have formal education in appraisals, and (iii) be members of a professional association involved in the education and certification of appraisers.
